In 2018, the vessel's owner, LesDick, the operating company LD Shipping, Graeme Pretty, an employee of slaughterhouse HW Greenham & Sons, and John McGee, the captain of the Statesman, were all sued for animal cruelty (including aggravated animal cruelty and management practices that could lead to unreasonable results).
Owner Les Dick pleaded not guilty, and before the trial began, he was diagnosed with a serious illness. This led to delays in the trial, with shipowner Les Dick reaching an agreement with prosecutors in 2020 to leave the livestock transport business. He passed away in February 2021. The operating company, LD Shipping, went into liquidation before being convicted, and its assets were sold to other operators.
This put Graeme Pretty, an employee of the slaughterhouse, and John McGee, captain of the Statesman, on trial. Later, the slaughterhouse's defense lawyers dropped the charges and succeeded. John McGee, the "Statesman" captain, became the sole defendant.
Last week, Captain John McGee pleaded guilty to one count of improper use of animal management methods that could lead to unreasonable results. His defense attorney told the court that at the time, Captain John McGee was under intense pressure from the ship's owner, Les Dick, to set sail. While the captain did have the final say, pressure from the owner influenced his decision. The lawyer stressed that the weather was worse than predicted and that the animals did not suffer in any way.
It is reported that Captain John McGee will face a sentence in January 2023. The charge carries a maximum penalty of 12 months in prison.
According to the data, Tasmanian ferry operator TT-Line was similarly charged in 2018 for an incident involving the death of 16 foals. Although the court ruled that TT-Line had 29 minor animal welfare violations, the company was ultimately acquitted.
